01 / About these terms
These Terms & Conditions explain how visitors may enquire about used construction and agricultural machinery. The seller is [REGISTERED SELLER NAME AND ADDRESS]. Any final contract must identify the actual seller and the agreed machine.
02 / Machinery listings
Listings provide preliminary product information. Year, operating hours, condition, attachments, specifications, availability and photographs should be verified against the specific machine and written sales documents before purchase. Obvious errors may be corrected before a binding agreement.
03 / Enquiries and contract formation
Sending an enquiry or requesting a quotation does not itself reserve a machine or conclude a sales contract. A binding agreement arises only in the manner expressly stated in the individual written offer and acceptance. The identity of the seller and buyer must be clear.
04 / Pricing and taxes
The binding quotation or sales agreement will identify the machine, total price, currency, applicable VAT treatment, any transport charges and additional costs. Displayed prices must comply with applicable pricing law, including any mandatory consumer-facing disclosures.
05 / Payment and documentation
The payment method, due dates and recipient account must be stated in the individual agreement. Buyers should independently verify payment instructions through an established contact channel. An invoice and relevant purchase documentation should be provided as required by law.
06 / Inspection and machine condition
Prospective buyers may request available inspection arrangements and information about the machine’s condition. Any inspection, acceptance procedure or agreed defects must be documented accurately and must not override mandatory buyer rights.
07 / Collection and delivery
Collection location, delivery destination, shipping responsibility, costs, estimated dates and transfer of risk must be set out in the individual contract. International delivery may involve additional transport or customs requirements, depending on the destination.
08 / Warranty and statutory rights
Any commercial warranty or voluntary inspection period is separate from statutory rights. Consumer rights cannot be excluded by general wording. For used goods sold to consumers, any lawful reduction of the statutory liability period requires the conditions prescribed by applicable law. [INSERT VERIFIED COMMERCIAL WARRANTY TERMS, IF OFFERED].
09 / Cancellation and withdrawal
Consumer distance-selling withdrawal rights may apply depending on the buyer, contract type and circumstances. Where legally required, the seller must provide a compliant withdrawal notice and model form. Do not assume that an advertised short inspection period replaces statutory withdrawal rights.
10 / Complaints, governing law and contact
Questions about a machine or an order may be sent to [BUSINESS EMAIL]. Any governing-law, jurisdiction or dispute-resolution provisions must be reviewed for the actual seller and target markets and must not deprive consumers of mandatory protections. [ADD REQUIRED CONSUMER INFORMATION].
